Car accident lawyer: What should you do after a car accident?
In this article I describe the theme of 'car traffic
accident', explaining what the causes can be and how to act if this happens to
you.
What should you do after a car accident?
If you have been the victim of a car accident there are a
few steps that you must follow in order to ensure that everyone is safe and
that you are complying with the law for the purpose of making a claim through
the insurer. According to insurers, the following steps will help you make
important decisions if you are involved in a car accident/traffic accident
whether or not the accident was caused by your fault.
STEP 1
Check yourself for possible injuries
If you have been injured, call 911 immediately or ask
someone else to do it for you. If you have been seriously injured, try not to
move and wait for the nursing staff.
STEP 2
Check your passengers for injuries
If you have virtually no injuries and can move safely, check
your passengers in the car. If someone has been injured, contact the emergency
services or ask an attendant to call for assistance.
STEP 3
Make sure you are safe
If possible try to move to the side of the road or to the
curb. If your car can still drive and poses a hazard on the road, move it to
the side of the road. In all other cases, leave the car behind and ensure that
you get to safety yourself.
STEP 4
Call 911
If the accident is a minor accident with only body damage or
a head-on collision, calling the police is important and recommended. The
police will fill out the claim form on the spot and map out the situation. If
the police cannot come to the location, fill in the claim form as best as
possible or go to the nearest police station. Your insurer may ask for the
police report when submitting your claim. This can help with a possible claim.
STEP 5
Wait for help
Turn off your engine and, if necessary, turn on the hazard
lights. Place a warning triangle at 200 meters to warn other road users.
STEP 6
Exchange information
If you are insured that no one has been injured, exchange
contact information and the details of the insurer. Keep in mind the following:
- Full name and contact information
- Insurer and policy number
- Driver's license and license plate number
- Vehicle make, color and model
- Place of the accident
We advise you not to discuss the cause of the accident when
going through the facts with the other driver. If you make an insurance claim,
a specialist will review your claim and determine who is at fault based on a
vehicle inspection, the information you have given and the other party involved
and any supporting material including the police report and on-site photos.
STEP 7
Record the accident in a document
We suggest you to take the following measures.
Identify the rescuers, and ask for names and numbers;
- Request a copy of the report: Ask the police officers for a copy of their report. your insurer may ask for this;
- Take Photos: Capture the accident by taking photos of your vehicle from multiple angles, showing the damage to both vehicles. Also, take a picture of the license plate of the other car. You can then transfer this to your insurer later.
- Write down the names and addresses of all parties involved, including the passengers in the other vehicle.
- Speak to witnesses. If there are witnesses, ask for their names and contact information.
STEP 8
Contact your personal injury lawyer
Personal injury lawyers know better than anyone how to
defend your interests. By briefly consulting a personal injury specialist, you
will be made aware of the additional aspects of an accident. In practice, we are
often happy that we are still alive and we don't want any trouble, but often
accidents turn out to lead to nasty consequences at a later time. Any
complaints that still exist weeks later or that emerge at once may be related
to the accident. If you do not settle this properly in advance, you will not
have a leg to stand on later and you may be confronted with high costs. You
don't want that. So, always consult with a personal injury attorney.
STEP 9
Inform your insurer and start with the claim
Contact your insurer in consultation with your lawyer.
Traffic accident with a car
An accident affects even the most experienced driver and can
cause you to act illogically. We have experienced countless times that victims
even forget to report the crime because they are so impressed by what happened.
If you follow the steps above, you have laid a good foundation for a successful
settlement of the damage and you do not have to worry much.
